You retain all ownership rights to the digital assets you create using the Platform. Gradian does not claim any ownership rights over your digital assets, including Non-Fungible Tokens (NFTs), virtual items, or any other content created or uploaded by you.
You agree not to use the Platform for any illegal activities, including but not limited to the creation or distribution of:

You are responsible for ensuring that your use of the Platform, including the creation and distribution of digital assets, complies with all applicable laws and regulations. This includes, but is not limited to, complying with securities laws, consumer protection laws, and intellectual property laws.
You acknowledge that the Platform is designed for the creation of legal digital assets that are either treated as commodities (e.g., artwork) or compliant with applicable regulations. Gradian is not responsible for any non-compliant activities or content created or distributed by you using the Platform.
The Platform is provided "as is," and Gradian makes no representations or warranties of any kind, whether express or implied, regarding the Platform's functionality, performance, or suitability for any particular purpose.
To the fullest extent permitted by law, Gradian will not be liable for any damages or losses resulting from your use of the Platform, including but not limited to any direct, indirect, incidental, special, consequential, or punitive damages, even if Gradian has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Gradian, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms of Service, or your infringement of any intellectual property or other rights of any third party.
